4. Developer Responsibilities

• Ensure your games comply with all applicable laws and regulations
• Provide accurate descriptions and pricing information
• Handle customer support for your games
• Maintain the quality and functionality of your games
• Not upload malicious, harmful, or inappropriate content
• Not sell games you did not create - This constitutes fraud and will result in immediate account termination
• Not resell games from other platforms or developers without explicit permission

5. Player Responsibilities

As a player purchasing games on GamePassed, you agree to:

• Provide accurate payment information
• Complete transactions in good faith
• Respect intellectual property rights
• Not attempt to circumvent payment systems
• Contact developers directly for support issues
• Use games in accordance with their intended purpose

6. Transaction System

GamePassed operates a secure transaction system using BTCPAY Server where:

• All payments are processed securely through BTCPAY Server
• Payments are held in escrow for 7 days for fraud protection
• We provide transaction verification and tracking services
• Developers keep 100% of their revenue after the escrow period
• No platform fees are charged
• Cryptocurrency payments are supported for enhanced privacy

By using our platform, you acknowledge that GamePassed uses BTCPAY Server for payment processing and maintains a 7-day escrow period for fraud protection.

7. Fraud Prevention and Escrow Protection

To protect both buyers and sellers, GamePassed implements the following fraud prevention measures:

• 7-Day Escrow Period: All payments are held securely for 7 days to allow for fraud detection and dispute resolution
• Fraud Detection: We actively monitor for suspicious activities including selling games you don't own
• Immediate Account Termination: Accounts found selling games they didn't create will be immediately terminated
• Legal Action: Fraudulent activities may result in legal action and reporting to authorities
• Escrow Protection: Payments are held in 7-day escrow to verify seller legitimacy and prevent fraudulent transactions
• Verification Process: We may request proof of game ownership from developers

Important: Selling games you did not create is fraud and will result in immediate account termination, forfeiture of escrow funds, and potential legal consequences.

8. Content Guidelines

All content uploaded to GamePassed must:

• Be original or properly licensed
• Not violate any copyright, trademark, or intellectual property rights
• Not contain hate speech, harassment, or discriminatory content
• Not promote violence, illegal activities, or harmful behavior
• Be appropriate for the intended audience
• Not contain malware, viruses, or other harmful code

9. Intellectual Property

You retain ownership of your content. By uploading to GamePassed, you grant us a limited license to:

• Display your content on our platform
• Use your content for promotional purposes
• Store and distribute your content as necessary for platform operation

You are responsible for ensuring you have the rights to all content you upload.

10. Prohibited Activities

You agree not to:

11. Disclaimers

GamePassed provides the platform "as is" without warranties of any kind. We are not responsible for:

• The quality, safety, or legality of games sold on our platform
• Payment disputes between buyers and sellers
• Technical issues with individual games
• Loss of data or content
• Service interruptions or downtime

12. Limitation of Liability

GamePassed shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

13. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may also terminate your account at any time.

Immediate Termination for Fraud: Accounts will be immediately terminated for selling games you did not create, reselling games without permission, or engaging in other fraudulent activities. This includes but is not limited to:

• Selling games you did not develop or own
• Reselling games from other platforms without permission
• Uploading pirated or unauthorized copies
• Providing false information about game ownership

Upon termination, your right to use the platform ceases immediately, but these Terms remain in effect. Fraudulent activities may also result in legal action and reporting to relevant authorities.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform constitutes acceptance of modified Terms.

15. Governing Law and Jurisdiction
